RESOLUTION NO. RS2011-1521

A resolution authorizing an agreement by and between the Metropolitan Government and The State of Tennessee for the repair of Manhole S4A.

WHEREAS, the Metropolitan Government owns and operates an energy distribution system as part of the Metro Nashville District Energy System, of which the State is a customer; and,

WHEREAS, the State owns an underground concrete vault located on the southeast corner of the intersection of Charlotte and 7th Avenue North in downtown Nashville and identified as Manhole S4A (the “Manhole”) through which pass certain parts of the EDS and State owned cabling; and,

WHEREAS, the Manhole is in disrepair and in need of rehabilitation; and,

WHEREAS, pursuant to the terms of the document, attached as Exhibit A, Metropolitan Government of Nashville proposes to repair the Manhole and costs associated with the remediation of the vault will be reimbursed by the State; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(a)(2)(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter agreements with the State of Tennessee by resolution; and,

WHEREAS, it is to benefit the citizens of The Metropolitan Government of Nashville and Davidson County that this agreement be accepted.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The agreement (Exhibit A) between the Metropolitan Government of Nashville and Davidson County and the State of Tennessee for the repair of Manhole S4A in Davidson County, Tennessee, attached hereto and incorporated herein, is hereby approved, and the Director of Finance and Director of Public Property are authorized to execute the same.

Section 2. That the amount of this contract or reimbursements therefrom be appropriated to the District Energy System.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
