RESOLUTION NO. RS2011-1520

A resolution approving an intergovernmental agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, and the State of Tennessee, Department of Transportation, for the implementation of the Warner Park Trails Linkage Improvements project.

WHEREAS, the intergovernmental agreement between the State of Tennessee, Department of Transportation, and the Metropolitan Government, by and through the Metropolitan Board of Parks and Recreation, attached hereto, specifies the parties’ roles and responsibilities with regard to the implementation of the Warner Parks Trail Linkage Improvements project; and

WHEREAS, Tennessee Code Annotated Section 12-9-104 provides that intergovernmental agreements between the State and political subdivisions of the State may be approved by resolution; and,

WHEREAS, it is in the interest of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, by and through the Metropolitan Board of Parks and Recreation, regarding the implementation of the Warner Parks Trail Linkage Improvements project, a copy of which is attached hereto and incorporated herein, is hereby approved and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
