RESOLUTION NO. RS2011-1519

A resolution authorizing the Metropolitan Mayor to sign a Notice of Limitation of Use pursuant to a grant from the State of Tennessee, Department of Environment and Conservation, to the Friends of Beaman Park for the Metropolitan Board of Parks and Recreation to construct walking trails in Beaman Park.

WHEREAS, the Friends of Beaman Park entered into a grant agreement with the State of Tennessee, Department of Environment and Conservation, in an amount not to exceed $85,000.00, with in-kind match provided by the Metropolitan Board of Parks and Recreation in the form of staff time, labor and materials, in an amount not to exceed $12,500.00, to construct walking trails in Beaman Park as part of the State’s Recreation Trails Program (RTP); and,

WHEREAS, under the RTP, use of state funds for such projects requires that the owner of the property sign a Notice of Limitation of Use; and,

WHEREAS, it is to benefit the citizens of The Metropolitan Government of Nashville and Davidson County that the Metropolitan Mayor be authorized to sign the Notice of Limitation of Use.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Mayor is authorized to execute the Notice of Limitation of Use, a copy of which is attached hereto and incorporated herein.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
