RESOLUTION NO. RS2010-1467

A resolution approving amendment one to grant agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Public Works, for the construction of 1,570 linear feet of sidewalk along Oakwood Avenue in the vicinity of Tom Joy Elementary School, PIN 112312.00.

WHEREAS, The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Public Works, previously entered into a grant agreement with the State of Tennessee, Department of Transportation, for the construction of 1,570 linear feet of sidewalk along Oakwood Avenue in the vicinity of Tom Joy Elementary School, PIN 112312.00, approved by RS2010-1373; and,

WHEREAS, the parties wish to amend the grant agreement by changing Section D.37 of the agreement, a copy of which amendment on is attached hereto; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that amendment one be accepted.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That amendment one to the Safe Routes to Schools Grant Agreement by and between The State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Public Works, for the construction of 1,570 linear feet of sidewalk along Oakwood Avenue in the vicinity of Tom Joy Elementary School, PIN 112312.00, a copy of which amendment one is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
