RESOLUTION NO. RS2010-1460
A resolution authorizing the Metropolitan Department of Law to compromise and settle the Metropolitan Government’s property damage claim against Shelly Murphy.
WHEREAS, on January 11, 2010, a Metropolitan Police Department vehicle operated by Metropolitan Officer Larry Scandrett was parked on the right side off ramp of I-40E investigating a previous traffic accident when Shelly Murphy made an improper lane change causing a five car chain reaction accident. Officer Scandrett’s vehicle was the last car to be struck, causing extensive damage to the Metropolitan Police Department vehicle; and,
WHEREAS, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government and recommends that the Metropolitan Government accept payment in the amount of $5,856.40 as compensation for all damages to Metropolitan Government property.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: The Metropolitan Department of Law is authorized to compromise and settle its recovery claim against Shelly Murphy in an amount totaling $5,856.40, which shall be deposited into an appropriate fund and account as determined by the Department of Finance.
Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
