RESOLUTION NO. RS2010-1455

A resolution approving an agreement by and between the Tennessee Department of Transportation and The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Public Works, for the widening and relocation of three ramps at the interchange of I-40 with McCrory Lane and realignment and widening of a portion of McCrory Lane, and authorizing the execution of the same. PIN Number 111068.00.

WHEREAS, The Metropolitan Government of Nashville and Davidson County has been awarded a local agency project agreement with the receipt and use of $4,000,000 in Local Interstate Connector and other State Transportation funds, for widening and relocation of three ramps at the interchange of I-40 with McCrory Lane and realignment and widening of a portion of McCrory Lane (the “Project”), PIN Number 111068.00, which project is to be constructed in cooperation with The Nashville Biltmore LP; and,

WHEREAS, Nashville Biltmore LP, and not the Metropolitan Government, is contributing all expenses associated with the Project in excess of those funded by the State of Tennessee through this agreement, as described in the Biltmore Agreement, attached hereto and incorporated herein; and,

WHEREAS, the Metropolitan Government will serve as the implementing agency for the Project, in accordance with the TDOT agreement; and,

WHEREAS, it is to benefit the citizens of The Metropolitan Government of Nashville and Davidson County that this local agency project agreement be accepted.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the agreement by and between the Tennessee Department of Transportation and The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Public Works, with an estimated $4,000,000 in Local Interstate Connector and other State Transportation funds, for widening and relocation of three ramps at interchange of I-40 with McCrory Lane and realignment and widening of a portion of McCrory Lane (the “Project”), PIN Number 111068.00, a copy of which contract is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That the funds obtained from this grant be appropriated to the Metropolitan Department of Public Works for the purpose of using these funds for the Project as provided in the Biltmore Agreement, a copy of which is attached hereto and incorporated herein.

Section 3. That any amendments, renewals or extensions of the terms of the agreement shall be approved by Resolution of the Metropolitan Council.

Section 4. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
