RESOLUTION NO. RS2010-1447

A resolution approving the amount of the application fee required for a certificate of public convenience and necessity for motorized, non-taxi passenger vehicles for hire.

WHEREAS, Ordinance No. BL2010-685 created and enacted Chapter 6.74 of the Metropolitan Code of Laws to regulate motorized, non-taxi passenger vehicles for hire; and,

WHEREAS, Amendment No. 1 to Ordinance No. BL2010-685 amended Section 6.74.030 to provide:

A. An application for a certificate of public convenience and necessity shall be filed with the MTLC for each classification of service to be provided. Forms will be provided by the commission and payment of a nonrefundable fee will be charged. The amount of the application fee shall be established by the MTLC and approved by the Metropolitan Council by resolution.

and;

WHEREAS, the Metropolitan Transportation Licensing Commission (“MTLC”), at a public hearing on August 24, 2010, established the nonrefundable fee for the certificate of public convenience and necessity application, as follows:
• for companies operating 1-5 vehicles, the amount of the application fee shall be two hundred dollars ($200);
• for companies operating more than five vehicles, the amount of the application fee shall be two hundred fifty dollars ($250).
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The non refundable, application fee for a certificate of public convenience and necessity for non-taxi passenger vehicles for hire, as established by the Metropolitan Transportation Licensing Commission, be approved, as follows:
• for companies operating 1-5 vehicles, the amount of the application fee shall be two hundred dollars ($200);
• for companies operating more than five vehicles, the amount of the application fee shall be two hundred fifty dollars ($250).

Section 2. This Resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
