RESOLUTION NO. RS2010-1409

A resolution approving an intergovernmental agreement between The Metropolitan Government of Nashville and Davidson County and the Metropolitan Transit Authority concerning the purchase and use of a parcel of property at 430 Myatt Drive in Davidson County.

WHEREAS, the Metropolitan Government, for the use and benefit of the Metropolitan Transit Authority (“MTA”), owns certain property located at 130 Nestor Street; and

WHEREAS, MTA’s operations have expanded significantly in recent years, and the space in the Nestor Street facility is no longer adequate for MTA’s needs; and

WHEREAS, the Nestor Street facility was significantly damaged during the flooding that occurred in early May; and

WHEREAS, MTA has an agreement, subject to certain conditions, to purchase a parcel of property, including the buildings thereon, located at 430 Myatt Drive (the “Property”) that is conveniently located and has sufficient space for MTA’s administrative and other operations; and

WHEREAS, the Property has sufficient space to house some of the functions of the Metropolitan Government, including the operations of the Metropolitan Police Department; and

WHEREAS, Tenn. Code Ann. §§ 12-9-101, et seq., authorizes the governing bodies of political subdivisions of the state to approve cooperative agreements by resolution; and

WHEREAS, the Metropolitan Government proposes to participate with MTA in the purchase of the Property and to share space, use and management of the Property as set forth in the Agreement attached to this resolution as Exhibit 1.

WHEREAS, it is in the best interests of the Metropolitan Government that the Agreement be approved.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Agreement is hereby approved for the Metropolitan Government upon fulfillment of the conditions precedent to MTA’s obligation to purchase the Property.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government requiring it.
