RESOLUTION NO. RS2010-1407

A resolution approving an intergovernmental agreement between the State of Tennessee, Department of Health, and the Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Clerk, for the provision and issuance of certificates from the birth record database.

WHEREAS, the State of Tennessee, Department of Health, is authorized by Tennessee Code Annotated, Section 68-3-101 et seq. to maintain vital records of persons born in Tennessee; and,

WHEREAS, the State of Tennessee, Department of Health, is authorized by Tennessee Code Annotated, Section 68-3-204 to issue reproductions of the original birth record; and,

WHEREAS, the State of Tennessee, Department of Health, maintains a birth record database (Automated Index Retrieval System, AIRS); and,

WHEREAS, the State of Tennessee, Department of Health, is authorized by Tennessee Code Annotated Section 68-3-206 to implement a pilot program for county clerks to issue certified copies of computer abstract birth certificates; and,

WHEREAS, the Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Clerk, desires to issue certified copies of computer abstract birth certificates from the AIRS database to enhance their ability to serve the citizens of Davidson County and Tennessee; and,

WHEREAS, the State of Tennessee, Department of Health, has proposed an intergovernmental agreement that will require a payment of $3.50 for the search and first copy of the birth certificate and $2.00 for each additional copy of the same certificate issued at the same time from the birth record database, plus fees for copies and searches pursuant to the Rules of the State of Tennessee, Department of Health, Chapter 1200-7-.13 by the Davidson County Clerk; and,

WHEREAS, the Davidson County Clerk desires to enter into this intergovernmental agreement with the State of Tennessee, Department of Health, and which is attached hereto and incorporated herein and provides further specific terms of the agreement; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104 authorizes the Metropolitan Government to enter into intergovernmental agreements with agencies of the state government by resolution approved by the governing body; and,

WHEREAS, it is a benefit to the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That the intergovernmental agreement by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Clerk, and the State of Tennessee, Department of Health, for the provision and issuance of certificates from the birth record database, a copy of which is attached hereto and incorporated herein, is hereby approved.

Section 2: That this resolution shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
