RESOLUTION NO. RS2010-1395
A resolution authorizing the Metropolitan Department of Law to compromise and settle the Metropolitan Government’s claim against Philip L. Beisswenger.
WHEREAS, on July 24, 2009, a Metropolitan Police Department vehicle operated by a Metropolitan Government employee, Officer John Donegan, was stopped in traffic on Woodmont Boulevard when Philip L. Beisswenger became distracted by his cell phone and struck Officer Donegan’s vehicle in the rear, resulting in personal injury to the Metropolitan Police Officer; and,
WHEREAS, the Metropolitan Government paid Officer Donegan’s medical costs resulting from the accident; and,
WHEREAS, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government and recommends that the Metropolitan Government accept payment in the amount of $9,648.57 as compensation for all costs incurred by the Metropolitan Government in Officer Donegan’s treatment.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: The Metropolitan Department of Law is authorized to compromise and settle the Metropolitan Government’s claim against Philip L. Beisswenger in an amount totaling $9,648.57 which shall be deposited into an appropriate fund and account as determined by the Department of Finance.
Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
