RESOLUTION NO. RS2010-1364

A resolution approving an interlocal agreement between The Metropolitan Government of Nashville and Davidson County, by and through the Metro Nashville Arts Commission, and the Convention Center Authority of the Metropolitan Government for art project management services for the Convention Center and Convention Center Complex.

WHEREAS, the Metropolitan Nashville Arts Commission has certain powers and duties with regard to public art selection and placement within the Metro area pursuant to the Metropolitan Code of Laws § 5.10.030; and,

WHEREAS, the Metropolitan Government and the Convention Center Authority (“Authority”) have an interest in the construction of a new Convention Center and the incorporation of cohesive art projects in and around the new Convention Center; and,

WHEREAS, the Authority is a public agency performing a public function pursuant to Tennessee Code Annotated § 7-89-101, et. seq. (“Act”); and,

WHEREAS, the Authority has requested that the Metropolitan Government provide art project management services for the Authority; and,

WHEREAS, under such Act the Metropolitan Government has the authority to assign or loan employees to provide services to the Authority; and,

WHEREAS, the Metropolitan Government and the Authority have agreed upon the terms of an interlocal agreement whereby the Metropolitan Government by and through the Metro Nashville Arts Commission agrees to provide the requested art project management services in exchange for payment of $200,000; and,

WHEREAS, Tennessee Code Annotated, § 12-9-104, provides that public agencies in Tennessee have the authority to enter into interlocal agreements to achieve common objectives subject to the approval by resolution of their respective governing bodies; and,

WHEREAS, approval of the interlocal agreement will benefit the citizens of Davidson County by providing for cohesive art projects in and around the Convention Center.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Interlocal Agreement by and between The Metropolitan Government of Nashville and Davidson County and the Convention Center Authority of The Metropolitan Government of Nashville and Davidson County for art project management services, attached hereto and incorporated herein, is hereby approved.

Section 2. That the funds received as compensation to the Metropolitan Government be appropriated to the Metro Nashville Arts Commission to support the functions designated in the Interlocal Agreement.

Section 3: That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
