RESOLUTION NO. RS2010-1336
A resolution authorizing the Metropolitan Department of Law to compromise and settle James Webster’s property damage claim against the Metropolitan Government for $21,435.53 from the Self-Insured Liability Fund.
WHEREAS, on February 3, 2010, the water pipes burst at James Webster’s home located at 1905 28th Avenue North. Mr. Webster had requested on November 25, 2009 that the Metropolitan Water and Sewer Department turn off the water to the home. Metropolitan Water and Sewer employee, Sandra Brumit failed to submit a work order to turn off the water. Mr. Webster’s home incurred property damages totaling $19,685.03 plus homeowner expenses of $1,750.50 for a total of $21,435.53; and,
WHEREAS, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government and recommends that the property damage claim be compromised and settled for $21,435.53, and that the amount be paid from the Self-Insured Liability Fund.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: The Metropolitan Department of Law is authorized to compromise and settle the property damage claim of James Webster in an amount totaling $21,435.53 with said amount to be paid from the Self-Insured Liability Fund.
Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
