RESOLUTION NO. RS2010-1314

A resolution authorizing the Metropolitan Department of Law to compromise and settle the lawsuit of Nancy Williams against The Metropolitan Government of Nashville and Davidson County and Buck Dozier, Executive Director of the Tennessee State Fair, in the amount of $30,264.34 and directing that this amount be paid from the Judgments and Losses Fund.

Whereas, Nancy Williams was terminated from employment with the Metropolitan Government, Board of Fair Commissioners on July 28, 2008; and

Whereas, Nancy Williams brought suit against the Metropolitan Government and Buck Dozier under the Fair Labor Standards Act (“FLSA”), and the Civil Rights Act; and

Whereas, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that this lawsuit be compromised and settled.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the lawsuit Nancy Williams v. Metropolitan Government et al., currently pending in the Chancery Court of Davidson County Docket No. 09-230-I, for the sum of $30,264.34, and that this amount be paid out of the Judgments and Losses Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
