RESOLUTION NO. RS2010-1261

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claims of Sam Glover, Jr. and Wackenhut Corporation asserted against The Metropolitan Government of Nashville and Davidson County for the total amount of $69,500, and directing that this amount be paid out of the Self-Insured Liability Fund.

WHEREAS, on June 6, 2006, Sam Glover, Jr., a Wackenhut security guard stationed at the Ben West Building, was injured when he tripped and fell on broken steps outside the Ben West Building while he was assisting Judge William Higgins with carrying a box of the Judge’s personal items; and,

WHEREAS, on June 5, 2007, as a result of this accident, Sam Glover, Jr. filed a lawsuit against the Metropolitan Government and Ray Bell Construction Company for injuries and damages that he suffered as a result of the accident, and Wackenhut Corporation filed an intervening complaint against the Metropolitan Government and Ray Bell Construction Company to recover its subrogation interest pursuant to its worker’s compensation lien; and,

WHEREAS, in full and final settlement of all claims brought by Sam Glover, Jr. and Wackenhut Corporation against the Metropolitan Government, the Metropolitan Government has reached a settlement wherein the Metropolitan Government will contribute $69,500 to the total settlement amount; and,

WHEREAS, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the Metropolitan Government’s best interest, and the Department of Law recommends that this lawsuit be compromised and settled for $69,500.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Department of Law is authorized to compromise and settle the lawsuit Sam Glover, Jr. and Wackenhut Corporation v. Metropolitan Government and Ray Bell Construction Company currently pending in the Sixth Circuit Court for Davidson County, Docket No. 07C-1619, for the sum of $69,500, and directing that this amount be paid out of the Self-Insured Liability Fund.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
