RESOLUTION NO. RS2010-1260

A resolution to amend Ordinance No. BL2010-646 and correct a typographical error related to the Instrument number for a public utility easement.

WHEREAS, Ordinance No. 2010-646 contains a typographical error by referring to Instrument number 2000305-0026279 for the 4,491.74 total square foot public utility easement to be abandoned by the Metropolitan Government of Nashville and Davidson County at 2312 Clifton Avenue; and,

WHEREAS, the correct Instrument number in reference to that public utility easement to be abandoned is Instrument number 20070305-0026279; and,

WHEREAS, Ordinance No. 2010-646 provides that amendments to the legislation shall be approved by resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Ordinance No. BL2010-646 is hereby amended, and Section 1 of Ordinance No. BL2010-646 shall reference the correct Instrument number 20070305-0026279 for the 4,491.74 total square foot public utility easement of the R.O.D.C., shown on Map 92-11, Parcel 386.00, 2312 Clifton Avenue.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonments authorized.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
