RESOLUTION NO. RS2010-1245

A resolution authorizing the Metropolitan Mayor to submit an Amendment to the 2010-2015 Consolidated Plan and 2010-2011 Action Plan for Housing and Community Development programs to the U.S. Department of Housing and Urban Development.

WHEREAS, in September 1994, the Metropolitan Council through Resolution R94-1396 designated the Metropolitan Development and Housing Agency (“MDHA”) as the lead agency responsible for the preparation of the Consolidated Plan for Housing and Community Development programs for The Metropolitan Government of Nashville and Davidson County; and

WHEREAS, the Metropolitan Council approved Ordinance BL 2009-599 authorizing the Mayor to submit the 2010-2015 Five Year Consolidated Plan for Housing and Community Development; and

WHEREAS, the Metropolitan Council approved Resolution RS 2010-1188 approving the 2010-2011 Action Plan and authorizing certain Housing and Community Development Funds; and

WHEREAS, on May 1 and 2, 2010, Metropolitan Nashville-Davidson County suffered severe flooding leading President Obama to declare Metropolitan Nashville-Davidson County a Federal Disaster Area; and

WHEREAS, many of the households impacted by the federal disaster are eligible for assistance under the Community Development Block Grant and HOME Investment Partnership program rules; and

WHEREAS, reallocation of available resources to prioritize the funds to assist the flood victims is in the community’s interest; and

WHEREAS, HUD allows amendments to the Five Year Consolidated Plan and the current year Action Plan providing the public participation process as outlined in the Consolidated Plan is followed; and

WHEREAS, Public Comment period is underway and a public hearing on the Consolidated Plan was held at the June 14, 2010, Federal Grants Review Committee meeting of the Metropolitan Council;

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Mayor is hereby authorized to submit an amendment to the 2010-2015 Five Year Consolidated Plan for Housing and Community Development and the 2010-2011 Action Plan to the U.S. Department of Housing and Urban Development to provide assistance to flood victims of Metropolitan Nashville and Davidson County.

Section 2. A description of the Amendment to the 2010-2015 Consolidated Plan and a 2010-2011 Action Plan is attached hereto and made a part of this Resolution.

Section 3. That the Metropolitan Development and Housing Agency is authorized to administer the Consolidated Plan on behalf of the Metropolitan Government of Nashville and Davidson County.

Section 4. This Resolution shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
