RESOLUTION NO. RS2010-1212

A resolution approving an agreement by and between the Tennessee Department of Transportation and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for the construction of 3,200 linear feet of sidewalk and bikeways along Harding Place, PIN Number 111998.00.

WHEREAS, The Metropolitan Government of Nashville and Davidson County has been awarded an enhancement agreement with an estimated cost of $862,840.20 for the construction of 3,200 linear feet of sidewalk and bikeways along Harding Place, PIN Number 111998.00; and,

WHEREAS, the agreement requires matching funds in an amount of twenty (20) percent of the construction cost, or $220,113, and coordination of non-participating items; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(a)(2)(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter agreements with the State of Tennessee by resolution; and,

WHEREAS, it is to benefit the citizens of The Metropolitan Government of Nashville and Davidson County that this enhancement agreement be accepted.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the agreement by and between the Tennessee Department of Transportation and The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Public Works, with an estimated cost of $862,840.20 for the construction of 3,200 linear feet of sidewalk and bikeways along Harding Place, PIN Number 111998.00, a copy of which contract is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That the amount of this contract be appropriated to the Metropolitan Department of Public Works based on the revenues estimated to be received and any match to be applied.

Section 3. That any amendments to this legislation may be processed by resolution.

Section 4. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
