RESOLUTION NO. RS2010-1191

A resolution expressing support for the Tennessee Healthcare Freedom Act.

WHEREAS, the Metropolitan Council recognizes the need for health care reform that will expand healthcare coverage and control costs; and

WHEREAS, the Council supports national reform, including tort reform and lifting of the prohibition on purchasing insurance across state lines; and

WHEREAS, the most efficient and equitable policies for reforming health care are those that rely on market forces and empower the individual; and

WHEREAS, the health care reform plan proposed by the Obama administration and recently passed by the U.S. Congress will greatly expand government control over the health care sector, which makes up 17% of the entire United States economy; and

WHEREAS, the Tennessee Healthcare Freedom Act provides that it is the public policy for the State of Tennessee that every Tennessean have the freedom to choose or decline to choose any mode of securing health care services without penalty or threat of penalty from the federal government; and

WHEREAS, this same Healthcare Freedom Act prohibits the government from imposing fines or penalties on Tennesseans’ decisions, and protects their rights to purchase and the right of doctors to provide lawful medical services without government fine or penalty.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as supporting the Tennessee Healthcare Freedom Act.

Section 2. That the Metropolitan Clerk is directed to send a copy of this Resolution to each member of the Davidson County Delegation to the Tennessee General Assembly.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
