RESOLUTION NO. RS2010-1190

A resolution authorizing the Metropolitan Department of Law to compromise and settle Steve Scales’, Reginald Scales’, Darlene Scales’, Tirell Scales’ and Sylvia Campbell’s claims against The Metropolitan Government of Nashville and Davidson County for the total amount of $243,000.00, and directing that this amount be paid out of the Self-Insured Liability Fund.

WHEREAS, on April 15, 2007, Steve Scales, Reginald Scales, Darlene Scales, Tirell Scales and Sylvia Campbell were driving southbound on Clarksville Pike when their car was struck by Metropolitan Police Officer Joshua Lunn as he attempted to turn left onto Ed Temple Boulevard; and,

WHEREAS, on April 14, 2008, Steve, Reginald, Darlene, and Tirell Scales and Sylvia Campbell brought suit against the Metropolitan Government for injuries and damages that they suffered as a result of the accident; and,

WHEREAS, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the Metropolitan Government’s best interest, and the Department of Law recommends that this lawsuit be compromised and settled.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Department of Law is authorized to compromise and settle the lawsuits, Steve Scales, et al. v. Metropolitan Government and Tirell Scales v. Metropolitan Government, currently pending in the Sixth Circuit Court for Davidson County, Docket Nos. 08C-1143 and 08C-1145, for the total sum of $243,000.00, and directing that this amount be paid out of the Self-Insured Liability Fund.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
