RESOLUTION NO. RS2010-1153

A resolution accepting a State Aid Contract from the Tennessee Department of Transportation to The Metropolitan Government of Nashville and Davidson County for the resurfacing of Fesslers Lane, Project No. 19-960-8404-04.

WHEREAS, the Tennessee Department of Transportation has awarded a state aid contract with an estimated cost of $136,725.00 to The Metropolitan Government of Nashville and Davidson County for the resurfacing of Fesslers Lane, Project No. 19-960-8404-04; and,

WHEREAS, the contract requires matching funds in an amount of $45,575.00; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(a)(2)(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter agreements with the State of Tennessee by resolution; and,

WHEREAS, it is to benefit the citizens of The Metropolitan Government of Nashville and Davidson County that this state aid contract be accepted.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the state aid contract by and between the Tennessee Department of Transportation with an estimated cost of $136,725.00 to The Metropolitan Government of Nashville and Davidson County, for the resurfacing of Fesslers Lane, Project No. 19-960-8404-04, a copy of which contract is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That the amount of this contract be appropriated to the Metropolitan Department of Public Works based on the revenues estimated to be received and any match to be applied.

Section 3. That any amendments to this legislation may be processed by resolution.

Section 4. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
