RESOLUTION NO. RS2010-1126

A resolution approving an amendment to a contract between The State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Public Works, for the widening of Central Pike, Contract No. 98-391.

WHEREAS, the Tennessee Department of Transportation has offered Amendment Two to the Metropolitan Government of Nashville and Davidson County, by and through the Department of Public Works, for the widening of Central Pike and replacement of a Nashville & Eastern Railroad Bridge over Central Pike; and,

WHEREAS, BL 99-1563 authorized the acceptance of the contract for the widening of Central Pike through Contract No. 98-391, under 23 U.S.C.A. § 133, Surface Transportation Program; and,

WHEREAS, Amendment One was approved by RS2009-904 to advance the Central Pike Project by using funds made available by the passage of the American Recovery and Reinvestment Act (“ARRA”) of 2009; and,

WHEREAS, Amendment Two to the contract is offered for the purpose of incorporating additional ARRA requirements for subcontracts and traffic control and shifting funds from right-of-way to construction costs and adding a utility phase to account for participating and non-participating utility items; and,

WHEREAS, BL 99-1563 authorizes amendments to the Central Pike contract by Resolution; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that said Amendment Two be accepted.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment Two to Contract No. 98-391 between the State of Tennessee, Department of Transportation, and the Metropolitan Government of Nashville and Davidson County, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
