RESOLUTION NO. RS2010-1115

A resolution authorizing the Metropolitan Department of Law to compromise and settle Paul Young’s claims against the Metropolitan Government of Nashville and Davidson County for the amount of $9,000.00, and directing that this amount be paid from the Self-Insured Liability Fund.

WHEREAS, on or before April 3, 2008, a representative of A & H Plumbing Company notified Metro Water Services of its intention to connect a residence located at 1570 Springfield Highway to the Metropolitan Government’s sewer line; and,

WHEREAS, on or before April 3, 2008, employees of Metro Water Services drilled a tap through hardware supplied and installed by the A & H Plumbing Company into what was believed to be the Metropolitan Government’s sewer line; and,

WHEREAS, employees of Metro Water Services unknowingly drilled the sewer tap into a potable drinking water main line owned by White House Utility District which provided water service to numerous customers in the area; and,

WHEREAS, Paul Young filed a lawsuit against the Metropolitan Government in the Circuit Court for Davidson County, Tennessee on April 9, 2009 alleging that the cross-connection contaminated the water supplied to his home and caused him injuries; and,

WHEREAS, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the Metropolitan Government’s best interest, and recommends that this lawsuit be compromised and settled.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Department of Law is authorized to compromise and settle the lawsuit Paul Young v. Metropolitan Government et al., Case No. 09C-1131, for
$9,000.00 and directs that this amount be paid from the Self-Insured Liability Fund.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
