RESOLUTION NO. RS2010-1114

A resolution authorizing the Metropolitan Government of Nashville and Davidson County to participate with the Williamson County Government to improve the public sewer service to the Town of Nolensville Fire Hall located at 7347 Nolensville Road in Williamson County by extending Metro’s sewer main along Nolensville Road (Project No. 09-SG-0046).

WHEREAS, pursuant to the terms of the document attached as Exhibit A, Williamson County Government and the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, propose to provide public sewer service to a development known as Town of Nolensville Fire Hall in Williamson County; and;

WHEREAS, The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, has built the Mill Creek Trunk Sewer, Project No. 98-SG-13, which consists of approximately 300 LF of 8 inch sewer main complete with appurtenances, extending along Nolensville Road; and,

WHEREAS, the Williamson County Government agrees to contribute 100% of the actual cost to a maximum of $50,000.00 toward the extension of Metro’s existing sewer main to serve the Town of Nolensville Fire Hall, so long as the sewer main is operational by September 30, 2011; and,

WHEREAS, Tenn. Code Ann. §§ 12-9-101, et seq., ("The Interlocal Cooperation Act") authorizes political subdivisions of the state to enter into cooperative agreements by resolution of the local governing body; and,

WHEREAS, it is in the best interest of The Metropolitan Government of Nashville and Davidson County to enter into said participation agreement with the Williamson County Government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The participation agreement (Exhibit A) between the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, and the Williamson County Government, to provide public sewer services in Williamson County, Tennessee to the development known as Town of Nolensville Fire Hall, Project No. 09-SG-0046, attached hereto and incorporated herein, is hereby approved, and the Mayor is authorized to execute the same.

Section 2. That the $50,000.00 from the Williamson County Government be deposited as a contribution-in-aid of construction in the Water and Sewer Extension and Replacement Fund No. 47335.

Section 3. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
