RESOLUTION NO. RS2009-979

A resolution authorizing the Director of Public Property to exercise an option to purchase property (Tax Map 091-14, Parcel 108) for The Metropolitan Government of Nashville and Davidson County (Proposal No.2009M-018PR-001).

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:

"Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the Metropolitan Government at a fixed price, subject to the approval of the metropolitan council by resolution, and no purchase shall be consummated until it has been so approved by the metropolitan council."; and

WHEREAS, Pursuant to and in accordance with section 2.24.250(F) of the Metropolitan Code of Laws, the Director of Public Property Administration has negotiated an option to purchase certain property located in Davidson County on parcel 108 on tax map 091-14, attached as Exhibit A and incorporated into this ordinance by reference; and

WHEREAS, it is in the best interest of the citizens of the Metropolitan Government to approve the purchase of said property;

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. That the Director of Public Property Administration is hereby authorized to exercise the option to purchase the improved property (Tax Map 091-14, Parcel 108, also known as 5500 Charlotte Avenue) as shown in Exhibit A and to execute the necessary documents pertaining thereto.

SECTION 2. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.

Madam President:

I move to amend RS2009-979 by deleting Section 1 and substituting with the following new Section 1:
“SECTION 1. That the Director of Public Property Administration is hereby authorized to exercise the option to purchase the improved property (Tax Map 091-14, Parcel 108, also known as 5500 Charlotte Avenue) as shown in Exhibit A, as well as the option extension as shown in Exhibit B, and to execute the necessary documents pertaining thereto.”
