RESOLUTION NO. RS2009-975

A resolution authorizing The Metropolitan Government of Nashville and Davidson County to enter into an agreement with the Town of Nolensville for the construction, maintenance, and operation of a sewer system by The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, within the corporate limits of the Town of Nolensville.

WHEREAS, the Town of Nolensville seeks to obtain sewer service for an area within its corporate limits; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water Services, is willing to construct a sewer system and provide sewer service in accordance with the terms set forth in the Agreement between The Metropolitan Government of Nashville and Davidson County and the Town of Nolensville, a copy of which is attached hereto as Exhibit A; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(a)(2)(b) authorizes the governing bodies of public agencies, such as metropolitan governments, to approve agreements between that public agency and another public agency, such as another political subdivision of the state of Tennessee, which would include an incorporated town, by resolution; and,

WHEREAS, Resolution No. 09-21 authorizing the execution of the attached Agreement between the Town of Nolensville and The Metropolitan Government of Nashville and Davidson County was approved by the Board of Mayor and Aldermen of the Town of Nolensville at its meeting on September 3, 2009 and the Mayor of the Town of Nolensville accordingly executed the attached Agreement on September 22, 2009; and,

WHEREAS, it is in the best interests of The Metropolitan Government of Nashville and Davidson County to enter into said Agreement with the Town of Nolensville.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Agreement by and between the Town of Nolensville and The Metropolitan Government of Nashville and Davidson County, attached hereto As Exhibit A and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute said Agreement.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
