RESOLUTION NO. RS2009-964

A resolution approving an intergovernmental agreement by and between the State of Minnesota, through its commissioner of Administration, Materials Management Division, and The Metropolitan Government of Nashville and Davidson County for cooperative purchasing.

WHEREAS, the intergovernmental agreement between the State of Minnesota, through its commissioner of Administration, Materials Management Division, and the Metropolitan Government of Nashville and Davidson County, attached hereto, specifies the parties’ roles and responsibilities regarding cooperative purchases; and,

WHEREAS, Tennessee Code Annotated Sections 12-9-103 and 12-9-104 provide that intergovernmental agreements between political subdivisions of the State and agencies of state governments in the United States may be approved by resolution; and,

WHEREAS, the State of Minnesota pursuant to its laws and through its participation in the Western States Contracting Alliance is able to make its contracts available to other governmental entities; and,

WHEREAS, the Metropolitan Government, through this cooperative purchasing agreement, can avail itself of the competitive prices negotiated by the State of Minnesota; and,

WHEREAS, it is in the interest of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the intergovernmental agreement by and between the State of Minnesota and The Metropolitan Government of Nashville and Davidson County regarding cooperative purchasing powers, a copy of which is attached hereto and incorporated herein, is hereby approved.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
