RESOLUTION NO. RS2009-944

A resolution approving amendment one to an agreement with Storm Reconstruction Services, Incorporated and The Metropolitan Government of Nashville and Davidson County for municipal solid waste collection services.

WHEREAS, the Metropolitan Government previously entered into an agreement with Storm Reconstruction Services, Incorporated for municipal solid waste collection services within the urban services district which agreement was approved by RS2004-579; and,

WHEREAS, the Metropolitan Council resolved that any amendments to the agreement must be approved by Resolution of the Metropolitan Council; and,

WHEREAS, the parties wish to amend the original agreement by suspending the provision of routine brush collection with an option for The Metropolitan Government of Nashville and Davidson County to reinstate the provision, a copy of which amendment one is attached hereto and incorporated herein; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that amendment one be approved.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That amendment one to the agreement between The Metropolitan Government of Nashville and Davidson County and Storm Reconstruction Services, for municipal solid waste collection services, attached hereto and incorporated herein, is hereby approved.

Section 2: That this Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
