RESOLUTION NO. RS2009-939

A resolution authorizing the Director of Public Property Administration, or his designee, to accept, execute and record a quitclaim deed from the State of Tennessee, acting by and through the Commissioner of Transportation, to The Board of Parks and Recreation of The Metropolitan Government of Nashville and Davidson County for a certain parcel of property with improvements consisting of an old steel truss bridge on Lebanon Road crossing Stones River (Proposal No. 2009M-016PR-001).

WHEREAS, pursuant to the terms of the quitclaim deed attached as Exhibit A to this ordinance, the State of Tennessee, Commissioner of Transportation, has agreed to donate to the Metropolitan Government all the interest it may possess in the real property and improvements (the “Property”) therein described; and,

WHEREAS, Tenn. Code Ann. §§ 12-9-101, et seq., ("The Interlocal Cooperation Act") authorizes political subdivisions of the State to enter into cooperative agreements by resolution of the local governing body; and,

WHEREAS, the Board of Parks and Recreation voted to approve the acceptance of the property via quitclaim deed at their meeting on September 1, 2009 in that the Property and the bridge it encompasses may be used in connection with the Stones River Greenway; and,

WHEREAS, the citizens of Nashville and Davidson County will benefit by accepting the Property.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Director of Public Property Administration, or his designee, is authorized to accept, execute and record a quitclaim deed from the State of Tennessee, acting by and through the Commissioner of Transportation, a copy of which is attached hereto and incorporated herein by reference.

Section 2. That this resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
