RESOLUTION NO. RS2009-913

A resolution approving the Second Amended Final Agreement with the United States Department of Justice and The Metropolitan Government of Nashville and Davidson County for structural changes to public buildings and facilities, excluding schools.

WHEREAS, by Resolution No. RS2006-1353, the Metropolitan Council approved an Amended Final Agreement with the United States Department of Justice regarding compliance with the Americans with Disabilities Act; and,

WHEREAS, the parties now wish to continue their compliance with the terms of the Amended Final Agrement, as set forth in the Second Amended Final Agreement attached hereto and incorporated herein; and,

WHEREAS, approval of the Second Amended Final Agreement is in the best interests of the Metropolitan Government of Nashville and Davidson County.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Second Amended Final Agreement between the United States Department of Justice and The Metropolitan Government of Nashville and Davidson County for structural changes to public buildings and facilities, excluding schools, attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
