RESOLUTION NO. RS2009-904

A resolution approving an amendment to a contract between the State of Tennessee, through the Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, through the Metropolitan Public Works Department, for the widening of Central Pike, Contract No. 98-391, Pin. No. 101200.00.

WHEREAS, the Tennessee Department of Transportation, has offered Amendment One to The Metropolitan Government of Nashville and Davidson County, through Metro Public Works, for the widening of Central Pike from State Route 24-Lebanon Road to the West End of the Stoner Creek Bridge, including replacement of the a Nashville and Eastern Railroad Bridge over Central Pike, Contract No. 98-391, Pin No. 101200.00; and,

WHEREAS, BL 99-1563 authorized the acceptance of the contract for the widening of Central Pike through Contract No. 98-391, under 23 U.S.C.A. §133, Surface Transportation Program; and,

WHEREAS, Amendment One to the contract is offered for the purpose of advancing the Central Pike Project by using funds made available by the passage of the American Recovery and Reinvestment Act of 2009; and,

WHEREAS, BL 99-1563 authorizes amendments to the Central Pike contract by Resolution; and,

WHEREAS, it is to the benefit of the citizens of the Metropolitan Government of Nashville and Davidson County that Amendment One be accepted.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment One to Contract No. 98-391 between the State of Tennessee, Tennessee Department of Transportation and the Metropolitan Government of Nashville and Davidson County, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized the execute the same.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
