RESOLUTION NO. RS2009-903

A resolution approving an Agreement between the Tennessee Department of Transportation, and the Metropolitan Government of Nashville and Davidson County, through the Metropolitan Public Works Department, and the Nashville & Eastern Railroad Corporation, and the Nashville & Eastern Railroad Authority for the widening of Central Pike.

WHEREAS, pursuant to BL 99-1563 , agreements between the State of Tennessee , through its Department of Transportation ( TDOT) and Metropolitan Government (CITY) may be approved by resolution for Central Pike widening including Nashville and Eastern Railroad Bridge , Contract No. 98-391, Pin No. 101200.00; and,

WHEREAS, pursuant to the terms of the agreement and attachments thereto (collectively ,the Agreement ) appended as Exhibit 1 and incorporated into this resolution by reference ,TDOT , proposes to reconstruct Central Pike from State Route 24 Lebanon Road to the west end of Stoner Creek Bridge under agreement Number. 705 and ,

WHEREAS, TDOT , City , the Nashville Eastern Railroad Authority ( NERA) and the Nashville and Eastern Railroad Corporation (NERC) have agreed to cooperate in the construction of railroad bridge for Central Pike improvements under agreement no. 705 and ,

Whereas any additional agreements or amendments for Central Pike , must be ratified by Resolution supported by 21 affirmative votes of the Metropolitan County Council prior to execution by the Metropolitan County Mayor; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that said agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Agreement No. 705 for Central Pike widening including the NERA bridge between TDOT , City , NERA , and NERC is hereby approved, and the Metropolitan Mayor is authorized the execute the same.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
