RESOLUTION NO. RS2009-892

A resolution approving an amendment to a grant from the U.S. Environmental Protection Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, for air pollution control.

WHEREAS, The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, previously entered into a Grant Agreement with the U.S. Environmental Protection Agency for air pollution control; and,

WHEREAS, the parties wish to amend the Grant Agreement to increase the amount of the grant by $92,761.00 from $681,931.00 to $774,692.00, a copy of which Amendment Three is attached hereto; and,

WHEREAS, Amendment Three does not amend the local match requirement of the original grant in the amount of $560,000.00, which grant agreement was approved by the Metropolitan Council by Resolution RS2007-53; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that Amendment Three be accepted.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment Three to the grant by and between the U.S. Environmental Protection Agency and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, for air pollution control, a copy of which Amendment Three is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That the amount of this grant is to be appropriated to the Metropolitan Board of Health, based on the revenues estimated to be received and any match to be applied.

Section 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
