RESOLUTION NO. RS2009-864

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of Stephanie Peete, as next of kin and personal representative of the estate of Federico Becerra, Jr., deceased, against the Metropolitan Government for the amount of $250,000.00 and directing that this amount be paid from the Judgment and Losses Fund.

Whereas, on July 15, 2004, Nashville Fire Department EMS personnel responded to a 911 call from the grandmother of Federico Becerra, Jr., who was having an epileptic seizure,

Whereas, after EMS arrived Mr. Becerra did not respond coherently to questions and was then restrained on the floor in an attempt to complete a medical assessment,

Whereas, during the restraint process, which included EMS personnel holding him down while he struggled, Mr. Becerra suffered a sudden cardiac arrest and died,

Whereas, after investigation, the Department of Law believes the settlement of $250,000.00 for Stephanie Peete, as next of kin and personal representative of the estate of Federico Becerra, Jr., is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that this lawsuit be compromised and settled, and that these amounts be paid from the Judgment and Losses Fund.

NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Department of Law is authorized to compromise and settle the claim of Stephanie Peete, as next of kin and personal representative of the estate of Federico Becerra, Jr., for the amount of $250,000.00, which amount shall be paid from the Judgment and Losses Fund.

Section 2. This Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
