RESOLUTION NO. RS2009-857

A resolution authorizing the acquisition of a parcel of property for use as part of the public park system.

WHEREAS, in accordance with the terms of the proposed deed attached as Exhibit 1 and incorporated into this resolution by reference, for the price of $1,500,000, Friends of Warner Parks proposes to sell to the Metropolitan Government a parcel of property (the “Property”) for use as part of the public park system; and

WHEREAS, in approving the Fiscal Year 2010 Capital Spending Plan under Resolution No. 2009-746, the Metropolitan Council authorized the expenditure of $1,500,000 towards acquisition of the Property;

WHEREAS, Friends of Warner Parks expects to convey to the Metropolitan Government a tract of land adjacent to the Property in a future donation, such additional tract also to be used as part of the public park system.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. The Director of Public Property or his designee is authorized to acquire the Property for use a part of the public park system pursuant to the terms of the proposed deed (Exhibit 1) and to execute any other documents reasonably necessary to effect the conveyance contemplated herein.

SECTION 2. This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
