RESOLUTION NO. RS2009-830

A resolution authorizing the Metropolitan Department of Law to compromise and settle Hoa Duong’s claims against The Metropolitan Government of Nashville and Davidson County for the amount of $12,000.00, and directing that this amount be paid out of the Self-Insured Liability Fund.

WHEREAS, on January 22, 2008, Hoa Duong sustained injuries while she was a passenger in a vehicle which was struck in the rear by a Metropolitan Public Works Department employee acting within the course and scope of his employment; and,

WHEREAS, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the Metropolitan Government’s best interest, and recommends that Hoa Duong’s personal injury claim be compromised and settled.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Department of Law is authorized to compromise and settle the personal injury claims of Hoa Duong for $12,000.00 and directing that this amount be paid out of the Self-Insured Liability Fund.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
