RESOLUTION NO. RS2009-829

A resolution approving Amendment No. 1 to the Project Cooperation Agreement between the Metropolitan Government and the U.S. Department of the Army, through the Army Corps of Engineers, for stabilization and improvements to the Metro Center Levee and for construction of a greenway on the levee.

Whereas, the Metropolitan Government and the U.S. Department of the Army, through the Army Corps of Engineers, have reached an agreement on Amendment No. 1 to Project Cooperation Agreement whereby the U.S. Army Corps of Engineers will clear the vegetation from the banks, repair and improve the levee, and construct a new levee on the south side of the interstate; and

Whereas, the Project Cooperation Agreement was approved by the ordinance BL2000-574 and this legislation authorized; future approval of amendments by resolution receiving twenty-one (21) votes of the Metropolitan Council; and

Whereas, the Metropolitan Government's share of the project is estimated to be increased from $2,195,080.00; to $2,639,067.78 and
Whereas, it is in the public interest for the Metro Center Levee Project to proceed so the levee can be certified.

Now, therefore be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County.

Section 1: That Amendment No. 1 to the Project Cooperation Agreement, by and between The Metropolitan Government of Nashville and Davidson County and the U.S. Department of the Army, for construction of the Metro Center Levee Project, which Project Cooperation Agreement is attached hereto and made a part of this ordinance, be and the same is hereby approved and the Metropolitan Mayor is authorized to execute the Project Cooperation Agreement on behalf of the Metropolitan Government.

Section 2. That matching cash funds not to exceed Two Million, Six Hundred Thirty-Nine Thousand, Sixty-Seven Dollars and Seventy-Eight cents ($2,639,067.78) are, to be derived from the Stormwater Capital Program for Project No. 97-PW-019, Metro Center Levee Stabilization.

Section 3: That this resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
