RESOLUTION NO. RS2009-823

A resolution approving an amendment to a grant from the Tennessee Emergency Management Agency to The Metropolitan Government of Nashville & Davidson County for the purchase and removal of 5405 and 5409 San Marcos Drive located in a repetitively flooded area.

WHEREAS, the Metropolitan Government, through the Metropolitan Council’s passage of Resolution RS2008-584, previously accepted a grant from the Tennessee Emergency Management Agency in an amount not to exceed $547,635.00 with a local match of $182,545.00 for the purchase and removal of 5405 and 5409 San Marcos Drive which lie in a repetitively flooded area; and,

WHEREAS, the Tennessee Emergency Management Agency, after the Metropolitan Council’s passage of Resolution RS2008-584, sought to amend the language of the contract in a manner that does not alter the essential content of the contract; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville & Davidson County that this amendment to the grant contract, previously approved by the Metropolitan Council by Resolution RS2008-584 be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the amendment to the grant by and between the Tennessee Emergency Management Agency and The Metropolitan Government of Nashville and Davidson County to purchase and remove 5405 and 5409 San Marcos Drive which lie in a repetitively flooded area, a copy of which amendment is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

SECTION 2. Any further amendments to this legislation may be approved by resolution.

SECTION 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville & Davidson County requiring it.
