RESOLUTION NO. RS2009-809

A resolution approving an agreement between The Metropolitan Government of Nashville and Davidson County, The State of Tennessee, through its Department of Transportation, and CSX Transportation, Inc., relating to the demolition and replacement of the Chestnut Street Bridge (Proposal No. 2009M-010PR-001).

WHEREAS, pursuant to BL2002-945, agreements between the State of Tennessee, through its Department of Transportation (“TDOT”), and the Metropolitan Government may be approved by resolution; and

WHEREAS, pursuant to the terms of the agreement and attachments thereto (collectively, the “Agreement”) appended as Exhibit 1 and incorporated into this resolution by reference, TDOT proposes to demolish and replace (the “Project”) the Chestnut Street Bridge (the “Bridge”) over a railroad belonging to CSX Transportation, Inc. (“CSX”); and

WHEREAS, further pursuant to the terms of the Agreement, CSX proposes to convey its interest in the Bridge and associated easements to the Metropolitan Government, together with certain funding for the Project; and

WHEREAS, approval of the Agreement (Exhibit 1) will permit the Project to be undertaken for the benefit of the citizens of Nashville and Davidson County.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Agreement is hereby approved.

Section 2. The Director of Public Works is authorized to execute the documents comprising the Agreement and such other documents as may be necessary to effect the conveyance of the Bridge and associated easements to the Metropolitan Government.

Section 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
