RESOLUTION NO. RS2009-785

A resolution authorizing the Metropolitan Department of Law to compromise and settle Timothy Lyons’ claims against the Metropolitan Government for the amount of $20,000, and directing that this amount be paid from the Self-Insured Liability Fund.

WHEREAS, on June 18, 2007, Timothy Lyons sustained injuries after his vehicle was struck in the rear by a vehicle driven by a metropolitan police officer acting within the course and scope of his employment;

WHEREAS, on March 20, 2008, Mr. Lyons initiated a civil action against the Metropolitan Government in Davidson County Circuit Court;

WHEREAS, the Department of Law believes that the settlement set forth in Section 1 is fair, reasonable, and in the Metropolitan Government’s best interest;

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Department of Law is authorized to compromise and settle the claims of Mr. Lyons for $20,000 with said amount to be paid from the Self-Insured Liability Fund.

Section 2. This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
