RESOLUTION NO. RS2009-784
A resolution authorizing the Metropolitan Department of Law to compromise and settle Barbara Brooks’s claims against the Metropolitan Government of Nashville and Davidson County for the amount of $20,000.00, and directing that this amount be paid out of the Self-Insured Liability Fund.
WHEREAS, on June 10, 2005, Barbara Brooks rented a vendor stall at the Farmer’s Market to sell items at the market. A tarp and metal pole separating her stall from the outside was not functioning properly, and the tarp and pole fell on Ms. Brooks’s head; and,
WHEREAS, on May 22, 2006, Ms. Brooks brought suit against the Metropolitan Government for injuries suffered as a result of the accident; and,
WHEREAS, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the Metropolitan Government’s best interest, and recommends that this lawsuit be compromised and settled.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Department of Law is authorized to compromise and settle the lawsuit Barbara Brooks v. Metropolitan Government, currently pending in the Circuit Court of Davidson County, Docket No. 07C-369, for the sum of $20,000.00, and directing that this amount be paid out of the Self-Insured Liability Fund.
Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
