RESOLUTION NO. RS2009-728
A resolution supporting state legislation to provide tax incentives for the planting of new and/or replacement trees as part of commercial and residential development.
WHEREAS, the Metropolitan Council has taken a leadership role in Nashville through the enactment of legislation to encourage sustainable building practices, to promote environmental conservation, and to reduce air and water pollution; and
WHEREAS, protecting the tree canopy in Nashville and throughout the state of Tennessee is one way to ensure that future generations have a safe and healthy environment in which to live, work, and play; and
WHEREAS, in an effort to protect the tree canopy in Nashville, the Metropolitan Council recently enacted Substitute Ordinance No. BL2008-328 to establish tree density standards for residential development; and
WHEREAS, legislation is currently pending in the Tennessee General Assembly that would allow local governments to provide a tax incentive for trees purchased to reach the property’s required tree density; and
WHEREAS, local governments should have the flexibility to provide tax incentives for developers and property owners desiring to protect the environment through the planting of new and/or replacement trees.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the Metropolitan County Council hereby goes on record as supporting state legislation to provide tax incentives for the planting of new and/or replacement trees as part of commercial and residential development.
Section 2. The Metropolitan Clerk is directed to send a copy of this Resolution to each member of the Davidson County Delegation to the Tennessee General Assembly.
Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
