RESOLUTION NO. RS2009-726

A resolution requesting Central Pike Investors, LLC, to maintain the recorded right-of-way easement from Dodson Chapel Road to the Chandler graveyard to allow community access to this historic site.

WHEREAS, Central Pike Investors, LLC, is currently in the process of developing property located at 3786 Central Pike for a mixed-use development; and

WHEREAS, a right-of-way easement was recorded in 1990 in the Davidson County Register of Deeds (Book 8158, Page 672) extending from Dodson Chapel Road across the property located at 3786 Central Pike and an adjacent tract to the Chandler graveyard; and

WHEREAS, the terms of the easement expressly provide that the easement is granted in favor of the Chandler family to provide access to the Chandler graveyard; and

WHEREAS, the Chandler graveyard is an historic heritage site in the Hermitage community, with graves dating back to the 1870’s; and

WHEREAS, the Chandler graveyard should be used as a buffer between the residential development along Dodson Chapel Road and the commercial development along Central Pike; and

WHEREAS, given the historical significance of the Chandler graveyard and the desire of the Chandler family to access the graveyard, it is fitting and proper that Central Pike Investors, LLC, maintain the existing right-of-way easement across the property located at 3786 Central Pike and allow the right-of-way to remain open for community access to the graveyard.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Council hereby goes on record as requesting Central Pike Investors, LLC, to maintain the recorded right-of-way easement from Dodson Chapel Road to the Chandler graveyard to allow community access to this historic site.

Section 2. The Metropolitan Clerk is directed to send a copy of this Resolution to Central Pike Investors, LLC, whose principal office is located at 5716 Hickory Plaza Drive, Suite 400, Nashville, Tennessee 37211.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
