RESOLUTION NO. RS2009-719

A resolution approving an amendment to a contract between The State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Public Works Department, for the Chestnut Street Bridge Replacement, Contract No. 2001659, Pin No. 1002005.00.

WHEREAS, the State of Tennessee, Department of Transportation, has offered Amendment One to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Public Works Department, for the Chestnut Street Bridge Replacement, Contract No. 2001659, Pin No. 1002005.00; and,

WHEREAS, BL 2002-945 authorized the acceptance of Contract No. 2001659 for LP 3349, Bridge over CSX Railroad (LM1.57), on Chestnut Street under 23 U.S.C.A., Section 144, Highway Bridge Replacement and Rehabilitation Program ; and,

WHEREAS, Amendment One to the contract is offered for the purpose of advancing the Chestnut Street Bridge Project construction phase by using funds made available by the passage of the American Recovery and Reinvestment Act of 2009; and,

WHEREAS, Section 3 of BL2002-945 authorizes that any and all additional contracts for LP No. 3349, Bridge over CSX Railroad (LM 1.57) on Chestnut Street between the State of Tennessee and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Public Works Department, must be ratified by Resolution supported by 21 affirmative votes of the Metropolitan County Council prior to execution by the Metropolitan County Mayor; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that Amendment One be accepted.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment One to Contract No. 2001659 between The State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Public Works Department, for the Chestnut Street Bridge Replacement, a copy of which Amendment One is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized the execute the same.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
