RESOLUTION NO. RS2009-691

A resolution expressing the Metropolitan Council’s desire that the Metropolitan Planning Commission notify adjacent counties whenever a subdivision request or zoning application is filed for property located on the county line.

WHEREAS, Davidson County adjoins Cheatham, Robertson, Sumner, Wilson, Rutherford, and Williamson Counties in Tennessee; and

WHEREAS, developments are proposed from time to time in Davidson County on the county line that would have a direct impact on one or more of the adjoining counties; and

WHEREAS, the Wilson County Commission recently adopted a resolution regarding procedures for notifying adjoining counties when a zoning action is proposed in Wilson County that would impact an adjoining county; and

WHEREAS, the Metropolitan Council is cognizant of the impact that development on the county line can have on the infrastructure of the adjoining county, as well as its citizens; and

WHEREAS, it is fitting and proper that the Metropolitan Planning Commission notify adjoining counties each time a development is proposed for Davidson County that would impact an adjoining county.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as expressing its desire that the Metropolitan Planning Commission notify the adjoining county whenever a zoning or subdivision request is filed in Davidson County that abuts an adjoining county. Specifically, the Metropolitan Council desires that the following procedure be established by the Planning Commission:
1. That the Metropolitan Planning Department contact the planning office of the adjoining county and advise them of the proposed action.
2. That the adjoining county’s planning office be requested to notify their county commission of the proposed action.
3. That the Metropolitan Planning Department likewise notify the office of the County Mayor of the adjoining county.

Section 2. The Metropolitan Clerk is directed to send a copy of this Resolution to Planning Director Rick Bernhardt and to each member of the Metropolitan Planning Commission.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
