RESOLUTION NO. RS2009-674

A resolution approving the exercise of fee simple acquisition option for the purchase of various flood prone property, for Metro Water Services Project No. 02-D-149 (Proposal No. 2002M-111U-12).

WHEREAS, it is in the public interest for The Metropolitan Government of Nashville & Davidson County to acquire certain flood-prone property; and,

WHEREAS, the Property shown on the list below is flood-prone; and,

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:

“Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the Director of Public Property shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the Metropolitan Government at a fixed price subject to the approval of the Metropolitan Council by resolution, and no purchase shall be consummated until it has been so approved by the Metropolitan Council”; and,

WHEREAS, pursuant to the terms of the documents collectively attached and the Fee Simple Acquisition Option to this resolution, Option permitting the Metropolitan Government to purchase the Property have been obtained; and,

WHEREAS, the purchase of the Property, identified as Metro Water Services Project No. 02-D-149, has been funded under Business Unit No. 65701721, Fund No. 37100 and approved by the Metropolitan Planning Commission on October 29, 2002, Proposal Number 2002M-111U-12.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Director of Public Property, or his designee, is hereby authorized to exercise the Fee Simple Acquisition Option attached and to execute such documents as may be necessary to effect the acquisition of the Property by the Metropolitan Government.

Section 2. This Resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville & Davidson County requiring it.
