RESOLUTION NO. RS2009-663
A resolution authorizing the director of the Department of Codes Administration to add the National Green Building Standard as a protocol for sustainable design development as part of the “Green Permit” provisions established pursuant to Section 16.36.050 of the Metropolitan Code.
WHEREAS, on February 11, 2008, the Metropolitan Council adopted Resolution No. RS2008-156 requesting the Vice Mayor to appoint a Green Permit Task Force to make recommendations to the Council regarding the appropriate sustainable building protocol for the Department of Codes Administration to use in recognizing facilities in Nashville as being “Green”; and
WHEREAS, on April 17, 2008, the Green Permit Task Force recommended that “green permits” be issued to builders/developers who comply with particular protocols for sustainable design; and
WHEREAS, on June 3, 2008, the Metropolitan Council enacted Ordinance No. BL2008-217 establishing a “Green Permit” for sustainable design development, which is to be issued by the Department of Codes Administration to buildings meeting the sustainable design protocols provided in the ordinance; and
WHEREAS, Ordinance No. BL2008-217 designated the U.S. Green Building Council’s LEED certification program and the “EarthCraft House” green building program as the sustainable design protocols; and
WHEREAS, Ordinance No. BL2008-217 authorized the Department of Codes Administration to develop and implement additional green building certification programs subject to approval of the Council by resolution receiving twenty-one (21) affirmative votes; and
WHEREAS, the National Association of Home Builders and the International Code Council, Inc. jointly developed the National Green Building Standard as an American National Standards Institute (ANSI) consensus standard; and
WHEREAS, the National Green Building Standard (ICC 700-2008) is the first green building rating system to be approved by ANSI, making it the benchmark for green homes; and
WHEREAS, the Director of the Department of Codes Administration has recommended that the National Green Building Standard be added as a permissible standard for the “Green Permit” program.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Director of the Metropolitan Department of Codes Administration is hereby authorized to add the National Green Building Standard (ICC 700-2008) as a sustainable design protocol for which a certified residential building shall be eligible to obtain a “green permit” pursuant to Section 16.36.050 of the Metropolitan Code.
Section 2. This Resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
