RESOLUTION NO. RS2009-628

A resolution approving an Interlocal Agreement between The Metropolitan Government of Nashville and Davidson County and the City of Franklin for the purpose of stabilizing the net expense incurred in the purchase of gasoline and/or diesel fuel prices.

WHEREAS, The Metropolitan Government of Nashville and Davidson County ("Metropolitan Government") and the City of Franklin ("the City"), have a common interest in stabilizing both gasoline and diesel fuel costs; and,

WHEREAS, Tennessee Code Annotated, Section 7-51-911 authorizes local governments to enter into negotiated agreements for the purpose of stabilizing the net expense incurred in the purchase of gasoline and/or diesel fuel; and,

WHEREAS, the Metropolitan Government anticipates that it will execute a Master Agreement with Fifth Third Bank pursuant to Ordinance No. BL2008-371 for the purpose of stabilizing the net expense incurred in the purchase of gasoline and/or diesel fuel; and,

WHEREAS, the Metropolitan Government anticipates executing, from time to time, specific agreements setting fuel prices with Fifth Third Bank pursuant to terms of Master Agreement; and,

WHEREAS, the Metropolitan Government and the City have agreed upon the terms of an interlocal agreement whereby the Metropolitan Government will act as the lead agency in the fuel stabilization agreements with Fifth Third to stabilize fuel prices ; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104, provides that interlocal agreements between governments may be approved by resolution; and,

WHEREAS, there has been presented with this resolution the Interlocal Agreement executed by the City, which is the appropriate instrument to be executed and delivered for the purposes intended; and,

WHEREAS, it is to benefit the citizens of the Metropolitan Government that this Interlocal Agreement be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Interlocal Agreement by and between The Metropolitan Government of Nashville and Davidson County and the City of Franklin for the purpose of stabilizing the net expense incurred in the purchase of gasoline and/or diesel fuel prices be and the same is hereby approved and the Metropolitan Mayor is hereby authorized to execute said Interlocal Agreement.

Section 2. That this resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
