RESOLUTION NO. RS2009-620
A resolution requesting the Metropolitan Board of Fire and Building Code Appeals to grant automatic extensions for existing facilities that have filed appeals seeking relief from the automatic sprinkler requirement while Ordinance No. BL2008-350 is pending with the Metropolitan Council.
WHEREAS, on April 17, 2007, the Metropolitan Council enacted Ordinance No. BL2007-1390, which, in part, adopted the 2006 NFPA 1 Uniform Fire Code of the National Fire Protection Association; and
WHEREAS, part of the local amendments to the 2006 NFPA 1 Uniform Fire Code and the Life Safety Code of the National Fire Protection Association requires owners of certain existing buildings to retrofit their facilities by installing automatic sprinkler systems; and
WHEREAS, the Tennessee Department of Commerce and Insurance has recently adopted the 2006 International Fire Code as the fire code for use throughout the state of Tennessee, to become effective December 20, 2008; and
WHEREAS, Ordinance No. BL2008-350 is currently pending with the Metropolitan Council that would adopt the 2006 International Fire Code as the fire code for use throughout the Metropolitan Government; and
WHEREAS, in light of the pending legislation to adopt the International Fire Code in place of the NFPA Uniform Fire Code and Life Safety Code, it is fitting and proper that the Board of Fire and Building Code Appeals grant automatic extensions for establishments that have appealed the sprinkler retrofit requirement.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the Metropolitan County Council hereby goes on record as requesting the Metropolitan Board of Fire and Building Code Appeals to grant automatic extensions for existing facilities that have filed appeals seeking relief from the automatic sprinkler requirement while Ordinance No. BL2008-350 is pending with the Metropolitan Council.
Section 2. The Metropolitan Clerk is directed to send a copy of this Resolution to each member of the Metropolitan Board of Fire and Building Code Appeals, to Fire Chief Stephen Halford, and to Fire Marshal Danny Hunt.
Section 3. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
