RESOLUTION NO. RS2009-614

A resolution authorizing the Metropolitan Department of Law to compromise and settle Evelyn Dobbins’ personal injury claim against The Metropolitan Government of Nashville and Davidson County for the amount of $10,000.00.

WHEREAS, on August 23, 2005, Evelyn Dobbins injured herself after tripping on a sidewalk maintained by the Metropolitan Government Public Works Department; and,

WHEREAS, on August 22, 2006, Evelyn Dobbins initiated a civil action against The Metropolitan Government of Nashville and Davidson County in the Sixth Circuit Court, Docket No. 06C2195; and,

WHEREAS, the Department of Law believes that the settlement set forth in Section 1 is fair, reasonable, and in the Metropolitan Government’s best interest, and recommends that the claim be compromised and settled for an amount not to exceed $10,000.00, and that this amount be paid from the Self-Insured Liability Fund.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Department of Law is authorized to compromise and settle the claim of Evelyn Dobbins for the amount of $10,000.00 with said amount to be paid from the Self-Insured Liability Fund.

Section 2. This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
