RESOLUTION NO. RS2009-1078

A resolution authorizing the Metropolitan Department of Law to compromise and settle the Metropolitan Government’s property damage claim against Trina Underwood.

WHEREAS, on March 27, 2009, Trina Underwood was traveling west on Charlotte Avenue approaching the intersection of 21st Avenue North and Charlotte. While talking on her cell phone, she became distracted and did not notice that traffic had stopped. She lost control of her vehicle, jumping the curb and crashed into Metro Fire Station #19 damaging two air conditioner/heat pump units and a large awning; and,

WHEREAS, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government and recommends that the Metropolitan Government accept payment in the amount of $14,093.80 as compensation for all damages to Metropolitan Government property.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle its recovery claim against Trina Underwood in an amount totaling $14,093.80, which shall be deposited into an appropriate fund and account as determined by the Department of Finance.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
